EU is the largest market in the world and also Korea``s primary trade partner. Thus, Korea and EU may have trade disputes in all times, and there is the possibility to Korea take anti-dumping measures considered as the significant trade remedy from EU. Although EU adopted Anti-dumpng agreement under WTO into EU Anti-dumping Law, it has its own Anti-dumping procedures and regulations such Community Interest. Hence, the necessity to know the Anti-dumping Basic Regulation(1225/2009) which plays the role as the most important source of the law and fundamental regulation in anti-dumping measures is obvious. Korea was imposed an anti-dumping measure from the United states last year in an export of OCTG, which caused quite important issues.
EU, not much as China, takes an anti-dumping measure to Korea. Moreover, through amending in 2014 on the Basic Regulation, EU Commission was granted more authorities about investigation and implementation on anti-dumping measures. In this paper, we search the procedures and the decision-making process in the Basic regulation and the direction on the context of its amendment. In addition, the statistic about EU``s recent trade remedies shows EU Commission considerably depends on anti-dumping measures. Above all things, the application of the regulation can be clarify by analyzing quoted Implementing Regulations in this paper; Russia aluminum foil Case, China PSC wires and strands case, Korean·Japan·Russia·China·US grain-oriented flat-rolled products of silicon-electrical steel case.
